Privacy Statement | InBrain

This privacy statement was last updated on May 17, 2023.

This is the privacy statement for the website of InBrain B.V. (hereinafter referred to as inBrain or us). Because you use our services and/or website (https://www.inbrain.nl), we process your personal data. Your privacy is of great importance to inBrain. We therefore adhere to the General Data Protection Regulation (hereinafter AVG).

Our privacy statement in brief

When processing personal data, we comply with privacy laws. This means that we:
Clearly define our purposes before we process your personal data, through this privacy statement.

  • Store as little personal data as possible and only the data needed for our purposes.
  • Explicitly seek consent to the processing of your personal data, should consent be required.
  • Take necessary security measures to protect your personal data. We also impose these obligations on parties who process personal data for us.
  • Respect your rights, such as the right to inspect, correct or delete your personal data processed with us.

For what purposes do we use your personal data?

By using our website, we obtain various personal data from you. For each purpose, we indicate what data we obtain from you, for what purpose we process it and for how long it is kept. If you have questions or want to know exactly what we track about you, contact inBrain. Contact information is at the bottom of this privacy statement.

Contact

When you fill out the online contact form, send an e-mail message, contact us by phone or otherwise contact us, you accept our offer to engage with us. This processing is therefore necessary for the performance of the agreement or we ask for your consent.

For this purpose, we process the following personal data:

  • Name
  • Contact information (e-mail address and phone number)
  • Any personal data you enter yourself as the content of a message

We keep your data for as long as necessary for this contact or for up to two years after we last had contact with you, because we want to make sure we have handled your question or complaint properly.

Commercial messaging

inBrain sends your commercial messaging in the form of digital newsletters. The website allows you to sign up for our commercial messaging. When we approach you as an existing customer with offers about our own and similar products and/or services, we do so on the basis of legitimate interest. If you are not an existing customer, or if the commercial communication does not involve our own and similar products and/or services, we will send it only with your permission.

For this purpose, we process the following personal data:

  • Name
Contact information (e-mail address and phone number)

We keep your personal data until you unsubscribe from commercial communications again. You can unsubscribe from these messages at any time. Each newsletter contains an unsubscribe link.

Scheduling a consultation

On our website, you can book a consultation to get answers to your e-commerce questions. In order to contact us and schedule an appointment, InBrain requires some personal information from you. Filling in your personal data (online) is necessary so that we can contact you about the consultation, therefore the processing is necessary for the performance of the agreement.

For this purpose, we process the following personal data:

  • Name
  • Contact information (business email address and phone number)
  • Company name (if a personal data)
  • Seniority/function

We keep your personal data for up to 5 years. We keep some data longer if we are legally required to do so (for example, because of the 7-year tax retention requirement).

Apply

Have you responded to one of our job openings or submitted an open application? If so, we process personal data about you in order to process your application, and in preparation for the possible conclusion of an employment contract.

For this purpose, we process the following personal data:

  • NAW data
  • Contact information (e-mail address and phone number)
  • Curriculum Vitae
  • Motivation letter
  • Salary Indication
  • References
  • Any other information you include with your application

We will retain your application information for up to 6 weeks after the position is filled. We keep this information so we can contact you in case the position becomes vacant again within the probationary period. If we cannot offer you a position at this time, we may – with your permission – keep the application data for an additional year. You can withdraw your consent at any time by sending us an e-mail. If you join us, we will keep your application information in your personnel file. This file will be kept as long as necessary.

A social media and Internet survey may be part of the application process. This is necessary to ensure that when hiring new staff our image is maintained, we do so based on our legitimate interest. To do this, we search your name on Google, and your profile, if any, on various social media. This of course to the extent these profiles are public; we will not ask you to grant us access to a protected social media page or connect with us. The results of the examination will be discussed with you. Should you object to this, you can indicate this by e-mail at the time you apply.

When may we share your personal data with third parties?

InBrain shares your data with third parties only when permitted by current law. We may provide your personal information to third parties because:

  • we have engaged them to process certain data;
  • we have a legal basis;
  • we are required to do so by law (for example, if the police demand it in the case of suspected crime).

The parties that process personal data on our or your behalf are:

  • IT suppliers and service providers
  • Hosting Parties
  • Marketing Companies

To provide those services, InBrain may provide your personal data to parties based outside the European Economic Area (EEA). InBrain will only do so if there is an adequate level of protection for the processing of personal data.

InBrain takes appropriate technical and organizational measures with respect to the processing of personal data to be performed, against loss or against any form of unlawful processing (such as unauthorized access, impairment, modification or disclosure of the personal data).

Social media buttons
On our website, we use social media buttons, which redirect you to the social media platforms. This gives you the option to follow us and share content within the network. You will also come across ads on your social media page. The buttons work because of pieces of code that come from the social media networks. If you want to know what social media platforms do with your personal data, read the relevant privacy statement:
